Sand Creek Consultants is fully versed in EPA's All Appropriate Inquiry (AAI) rule which took affect on November 1, 2006. As a result of the AAI rule, Phase I ESA users (i.e. prospective purchasers) have additional responsibilities which they must perform prior to property purchase in order to be eligible for Landowner Liability Protections under CERCLA. In addition, some purchasers might be responsible for continuing obligations at a property, depending on the condition of the property at the time of sale. SCC will assist our clients in understanding their responsibilities both as prospective purchasers and as new owners of contaminated properties.
